The Food Safety and Standards Authority of India (FSSAI) has issued nine notices to Swiggy Instamart following multiple consumer complaints alleging violations under the Food Safety and Standards Act, 2006. The notices relate to a range of food safety concerns, including the alleged delivery of expired, spoiled, contaminated and improperly handled food products through the quick-commerce platform.
According to FSSAI, the complaints also highlighted concerns regarding food business licensing, product traceability, consumer grievance redressal, inventory management and overall compliance with food safety regulations. The regulator has sought a detailed explanation from the Food Business Operator (FBO) and directed it to submit documentary evidence addressing the allegations.
Allegations Highlighted in the Notices
The complaints reviewed by FSSAI reportedly include allegations of:
- Supply of expired, spoiled, rotten, contaminated and otherwise unsafe food products through Swiggy Instamart.
- Marketing of “NOICE” Eggs under product categories allegedly not covered by the existing FSSAI licence. The FBO has been directed not to market the product unless it is covered under a valid licence and to apply for licence modification if required.
- Alleged supply of expired products, including Healthify 100% Whey Protein 1 kg and Noice Homestyle Madras Mixture with Peanuts.
- Reports of Akshayakalpa Organic Eggs being received in an expired, rotten and contaminated condition, allegedly making them unfit for human consumption. The complaint also alleged that no corrective action was taken despite escalation.
- Complaints regarding Kakke da Paratha, which was reportedly spoiled, emitted a foul odour and was allegedly unfit for consumption.
- An infant food formulation reportedly found in a highly deteriorated and unsafe condition with signs of contamination and improper storage. The complaint further alleged that the same product was re-supplied after the defective product had been returned.
- Alleged delivery of contaminated eggs, milk and damaged packaged food items through the platform.
- Concerns regarding incorrect, invalid or non-existent FSSAI licence numbers and food business entities allegedly being listed under names different from those reflected in their FSSAI registration.
- Allegations that complaints were not adequately addressed despite being forwarded or escalated, with one complainant reportedly receiving only a refund without resolution of the food safety issue.
- Broader concerns relating to seller onboarding, compliance verification, traceability, food quality monitoring, supervision of food business activities and the effectiveness of food safety compliance systems.
Directions Issued by FSSAI
In its notices, FSSAI has directed the Food Business Operator to:
- Submit a detailed explanation supported by documentary evidence addressing each alleged non-compliance and the circumstances leading to the reported incidents.
- Provide complete details of quality assurance systems, food safety monitoring, inventory management, stock rotation, hygiene practices, storage conditions, handling procedures and internal controls adopted to ensure compliance with food safety standards.
- Submit details of corrective and preventive actions (CAPA), root cause analysis, consumer grievance redressal mechanisms and measures implemented to prevent recurrence of similar incidents.
- Furnish the required compliance report within the stipulated timeline, failing which appropriate action under the Food Safety and Standards Act, 2006 may be initiated.

The notices reflect increasing regulatory attention on food safety standards in India’s rapidly expanding quick-commerce sector. As online grocery and instant delivery services continue to grow, regulators are placing greater emphasis on ensuring that food products are stored, transported and delivered in compliance with prescribed safety and hygiene standards.
Food Business Operators operating through digital platforms are required to maintain valid FSSAI licences, implement robust quality control systems, ensure proper storage and inventory management, maintain product traceability and establish effective consumer grievance redressal mechanisms.
Regulatory Proceedings Underway
The issuance of notices does not constitute a final finding of guilt. The notices are based on allegations received through consumer complaints, and Swiggy Instamart has been given an opportunity to respond and submit its explanation along with supporting documents.
FSSAI will examine the response and compliance report before determining whether any further regulatory or legal action is warranted under the Food Safety and Standards Act, 2006.
