The Food Safety and Standards Authority of India (FSSAI) has initiated three separate adjudication cases against Nestlé India Limited concerning non-compliances linked to NAN Excella Pro Stage 1 and Lactogen Pro 1.
According to the FSSAI notice, the action followed an examination of the infant nutrition products and their promotional material available on e-commerce platforms.
Promotional Claims Under Scrutiny
FSSAI observed claims related to “5 HMOs” and “Whey Protein” in promotional material for NAN Excella Pro Stage 1. For Lactogen Pro 1, a claim describing “Whey Protein” as easy to digest was also observed.
FSSAI stated that these promotional claims were found to be in contravention of Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, which restricts promotional claims and material intended to increase the saleability of infant foods.
The notice also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, concerning restrictions on advertising and promotion.
Biotin Compliance Issue
Separately, a sample of a follow-up formula manufactured by Nestlé India was found to be sub-standard during laboratory analysis with respect to its biotin content.
The sample was subsequently sent for re-analysis, and the Referral Laboratory also found it to be non-compliant with the prescribed biotin requirements under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.
Three Adjudication Cases Filed
In view of the reported non-compliances, FSSAI stated that three separate adjudication cases have been filed against Nestlé India Limited in relation to the three products.
The action highlights the regulatory scrutiny surrounding infant nutrition products, their nutritional composition and promotional claims in India.
